Official Rules


NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The "Are You A Golf Digest Scholar?" Promotion (the "Promotion") consists of a merit and skill-based contest ("Contest") and a random-draw sweepstakes ("Sweepstakes"). The Promotion is open only to legal residents of the fifty (50) United States (excluding Maine) and the District of Columbia who are between the ages of thirteen (13) and seventeen (17) at the time of entry. Employees of the Sponsors and the immediate family (spouse, parents, siblings and children) and household members of each such employees are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Void in Maine, outside the 50 United States/DC and where prohibited. Participation in the Promotion constitutes entrant's full and unconditional agreement to these Official Rules and Sponsors' decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsors: The Conde Nast Publications, 4 Times Square, New York, NY 10036, Hank Haney International Junior Golf Academy, 55 Hospital Center Common, Hilton Head Island, SC 29926, and the Heritage Academy.

3. Timing: The Promotion begins on October 6, 2009 at 12:01 a.m. Eastern Time ("ET") and ends on March 24, 2010 at 11:59 p.m. ET (the "Promotion Period"). The Promotion consists of three (3) phases as set forth in the chart below:

Sponsors' computers are the official time-keeping device for this Promotion.

4. How to Enter:

a. To Enter the Contest. During the Entry Phase, visit http://www.golfdigestscholars.com and follow the links and instructions to complete and submit the registration including a valid home address. P.O. Boxes are not permitted. Then, follow the links and instructions to upload and submit an essay which must comply with the guidelines and restrictions below ("Essay"). If you do not submit an Essay at this time you will not have another opportunity to come back and submit your Essay. You will receive one (1) entry into the Contest and (1) one entry into the Sweepstakes. By completing the registration and submitting your Essay, you agree that your Essay adheres to the Guidelines and Content Restrictions as defined below (collectively, the "Essay Guidelines and Restrictions") and that Sponsors, in their sole discretion, may remove your Essay and disqualify you from the Contest if Sponsors believe, in their sole discretion, that your Essay fails to conform to the Guidelines and Restrictions. All entries may, at Sponsors' discretion, be posted online.

Essay Guidelines:

  • The Essay must not exceed one hundred (100) words; and
  • The Essay must describe why you think you deserve to receive a scholarship to the Hank Haney International Junior Golf Academy and the Heritage Academy.

Content Restrictions:

  • The Essay must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • The Essay must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
  • The Essay must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and
  • The Essay must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Essay/ Video is created.

For all Essays: Sponsors shall have the right to edit, adapt, display, distribute and publish any or all of the Essays, and may use them in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. Sponsors are not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected Essays, which are disqualified. Limit: one (1) Essay total during the Entry Phase.

b. To Enter the Sweepstakes. Entry into the Contest will simultaneously enter you one (1) time into the Sweepstakes. In addition, during the voting phase any legal resident over the age of 13 may visit http://www.golfdigestscholars.com, review the information for each Finalist of the Contest, and vote for the two (2) Finalists they believe most deserve to receive a scholarship to the Hank Haney International Junior Golf Academy and the Heritage Academy. Doing so will automatically enter such person one (1) time into the Sweepstakes. Each day a voter comes back to vote during the Voting Period, such voter will receive another entry into the Sweepstakes. Limit: Each voter may enter one (1) time per day during the Voting Period.

Any attempt by any entrant/voter to obtain more than the stated number of entries/votes by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant/voter's entries and that entrant/voter may be disqualified. Use of any bot or automated system to participate is prohibited and will result in disqualification. Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries/votes, which will be disqualified. In the event of a dispute as to any entry/vote, the authorized account holder of the email address used to register will be deemed to be the registrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

5. Winner Determination:

a. For Contest: Representatives of each Sponsor will judge all entry information, including Essays. Winner will be chosen based on Academic Performance/GPA (25%), Leadership (25%), Community Involvement (25%) and general golfing knowledge/or golfing experience (25%) ("Judging Criteria"). In the event of a tie between two (2) or more entrants, the Sponsors will determine the winning entrant in their sole discretion. Judges will select the three (3) - ten (10) entrants with the highest cumulative score as finalists (each a "Finalist"). The potential Finalists will be notified by email, telephone, or registered mail no later than February 10, 2010. After each potential Finalist is initially contacted by the Sponsors, such individual will be required to sign a release form, be interviewed by Sponsors and submit a video of his or her golf swing ('Video"). Once all Finalist Videos are complete, Sponsors may edit the Videos and the Essays to create an online profile for each Finalist (each a "Profile"). If any potential Finalist does not sign a release form, take an interview, and/or submit a Video, such potential Finalist will be disqualified. Release forms shall be executed by the Finalist's parent(s) or legal guardian if the Finalist is a minor in his/her state of residence. Beginning February 24, 2010 at 12:01 AM ET the Finalist's Profiles will be posted at http://www.golfdigestscholars.com for public voting during the Voting Phase. The Contest winner will be determined based on the number of votes received (40%) and the Sponsors' evaluation of the Judging Criteria above (60%). Potential Contest winner will be contacted on or around April 27, 2010

b. For Sweepstakes: Sponsors will randomly select the potential Sweepstakes winner from all eligible entries on or around April 27, 2010.

6. Verification of Potential Winners: Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential Sweepstakes winners and Contest winners (or his/her parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to Sponsors, within five (5) days of the date notice is sent, an Affidavit of Eligibility (including social security number), Liability & Publicity Release (except where prohibited) (the "Affidavit") in order to claim his/her prize. If a potential winner of any prize cannot be contacted, or fails to sign and return the Affidavit within the required time period (if applicable), he/she may forfeit the prize. If a potential Sweepstakes winner is disqualified for any reason, Sponsors will award the prize to an alternate potential winner by random drawing from among all remaining eligible entries. There will be five (5) alternate drawings, after which the applicable prize will remain un-awarded. If a potential Contest winner is disqualified for any reason, Sponsors will award the prize to the person whose Entry received the next highest number of votes.

7. Prizes:

a. Contest Prizes: TWO (2) GRAND PRIZES: A scholarship to The Hank Haney International Junior Golf Academy and the Heritage Academy in Hilton Head, SC will be awarded to one male and one female junior golfer (the "Scholarship"). Depending on the winner's age, the Scholarship may be between one (1) and up to four (4) academic years, at the sole discretion of the Sponsors. Scholarship includes tuition, room and board for the academic year. Scholarship shall be conditioned upon winner's compliance with all rules, regulations and standards of The Hank Haney International Junior Golf Academyand the Heritage Academy, including without limitation exemplary behavior and at least a 3.0 grade point average by the end of each semester in attendance. Winners will be required and agree to execute any and all typical documentation associated with enrollment in The Hank Haney Junior Golf Academy and the Heritage Academy. In addition, winners will receive three (3) roundtrip, coach-class airfare tickets (for winner and two parents) from the major commercial airport nearest the winner's primary residence in the US to Jacksonville, FL, one standard hotel room (triple-occupancy) for one (1) night at a hotel determined by Sponsors in their sole discretion and admission for three (3) to an awards ceremony in Jacksonville, FL on or about May 3, 2010 - May 10, 2010. Total Approximate Retail Value of the Grand Prize package is approximately $65,890 per year. (Value subject to change at Sponsors' sole discretion). Actual value may vary based on years applied to the Scholarship and fluctuations in price for airfare and/or accommodations. Winner will not receive difference between actual and approximate retail value.

b. Sweepstakes Prizes: ONE (1) GRAND PRIZE: Attendance at the Hank Haney International Junior Golf Academy in Hilton Head, SC for one Summer 2010 Camp. Prize includes one standard room for five (5) days/six (6) nights at the Hank Haney Junior Golf Academy, meals at the Academy, daily golf instruction, rounds of golf and range balls, group sessions of Mental and Fitness Training, as well as evening activities. Winner must travel on date determined by Hank Haney Junior Golf Academy, 2010 and return on date determined by The Hank Haney Junior Golf Academy, 2010 or prize will be forfeited. Trip must be booked at least twenty-one (21) days prior to departure. ARV(Actual Retail Value): $1,695. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. Winner must be between the ages of 13 and 17 to redeem this prize.

For Trip Prizes: Trips are subject to availability and blackout dates. Travel must be roundtrip. Sponsors will determine airline and flight itinerary in their sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsors' airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package descriptions above, including but not limited to, ground transportation, additional meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of winner, travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Notwithstanding the foregoing, if winner is a minor in his/her state of residence, travel companion must be winner's parent/legal guardian. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If, in the judgment of Sponsors, air transportation is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air transportation at Sponsors' sole discretion. Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.

For All Prizes: Prizes are not transferable or redeemable for cash and no substitution is allowed, except by Sponsors, who reserve the right to substitute a prize or prize component of comparable or greater value, in their sole discretion. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

8. Release: By receipt of any prize, each winner agrees to release and hold harmless Sponsors and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

9. Publicity: Except where prohibited, participation in the Promotion constitutes each winner's consent to Sponsors' and their agents' or assigns' use of winner's name, Essay, Video, Profile, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: Sponsors reserve the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsors' reasonable control impairs the integrity or proper functioning of the Sweepstakes or Contest, as determined by Sponsors in their sole discretion. In such event, Sponsors reserve the right to award the prizes, at random, from among the eligible entries received up to the time of the impairment. Sponsors reserve the right, in their sole discretion, to disqualify any individual they find to be tampering with the entry/voting process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsors' failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry/vote process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries/votes; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If, for any reason, an entrant's entry/vote is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another Sweepstakes or Contest entry/vote, provided that, if it is not possible to award another entry/vote due to discontinuance of the Promotion, or any part of it, for any reason, Sponsors, in their sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserve the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of New York or the appropriate New York State Court located in New York County, New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
